CHRISTIANE PERROCHON s.r.l. TERMS & CONDITIONS FOR USE OF CHRISTIANEPERROCHON.COM (the Site) I. SITE CONTENT AND USE A. The Site is owned and operated by Christiane Perrochon B. Images on the Site of people or places (the "Images") are the property of, or used with permission by, Christiane Perrochon You are prohibited from using the Images except as specifically permitted by the Site or this Agreement. Any unauthorized use of the Images by you may violate copyright trademark, privacy, publicity and communications laws, regulations and statutes. With the exception of news media subject to the specific conditions set forth in the Image Gallery portion of the Site, you may not copy, reproduce, republish, upload, post, transmit, distribute, or create derivate works from, the Images. Modification or use of the Images for any purpose not provided for within is a violation of Christiane Perrochon's and others copyright and other proprietary rights. For purposes of this Agreement, the use of the Images on any other Web site or networked computer environment is prohibited. C. The Site is intended to quickly and easily deliver the most requested Christiane Perrochon company information to information seekers. You may not download/print the Content, including the Trademarks and Images. You may not modify, redistribute, sell, repost, decompile, reverse engineer, or otherwise disassemble or create derivate works from the Content without the express permission of Christiane Perrochon II. JURISDICTIONAL ISSUES A. Unless otherwise specified, the Site Content is presented solely for the purpose of communicating information about Christiane Perrochon, its company practices and products. This Agreement is effective until terminated by either party. B. This Agreement will terminate immediately without notice from Christiane Perrochon if in Christiane Perrochon's sole discretion, you fail to comply with all of its terms or provisions. Upon V. NO WARRANTIES A. SITE CONTENT IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, Christiane Perrochon DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, NON INFRINGEMENT OF INTELLECTUAL PROPERTY, AND FITNESS FOR A PARTICULAR PURPOSE. B. Christiane Perrochon DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SITE OR SITE CONTENT WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR ITS SERVER ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. C. Christiane Perrochon DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF OR THE RESULTS OF THE USE OF THE SITE CONTENT IN THIS SITE IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. YOU (AND NOT Christiane Perrochon) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTIONS WHICH MAY BE REQUIRED AS A RESULT OF YOUR USE OF THIS SITE. D. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. VI. LIMITATION OF LIABILITY A. Christiane Perrochon makes reasonable efforts to place accurate, current Content on the Site; however, Christiane Perrochon makes no warranties or representations as to its accuracy and assumes no liability or responsibility for any errors or omissions in Site Content. Under no circumstances, including, but not limited to, negligence and gross negligence, shall Christiane Perrochon be liable for any direct, incidental, special, consequential, indirect, or punitive damages resulting from the use of, or the inability to use, the Site or Content, even if Christiane Perrochon or an Christiane Perrochon authorized representative has been advised of the possibility of such damages. In no event shall Christiane Perrochon's total liability to you for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence), or otherwise) exceed the amount paid by you, if any, for accessing the Site. B. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. VII. AGREEMENT ENFORCEABILITY A. This Agreement shall be governed by and construed in accordance with the laws of the State of Italy, without regard to any principles of conflicts of law. If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. B. This is the entire agreement between the parties relating to the subject matter herein. C. Christiane Perrochon reserves the right to, and may at any time revise this Agreement on the Site. Any such revisions are binding on you, and Christiane Perrochon recommends that you revisit this page from time-to-time to review the then current Agreement. |
